Terms & Conditions

These Terms and Conditions govern all transactions and engagements with Al Sabah Motors and are governed exclusively by the laws of the State of Kuwait.

1. Definitions

In these Terms and Conditions, the following definitions apply:

  • "Company" / "Al Sabah Motors" / "We" / "Us" — refers to Al Sabah Motors, a commercial entity registered and operating in the State of Kuwait.
  • "Client" / "Customer" / "You" — refers to any individual, corporate entity, or organization engaging Al Sabah Motors for vehicle import services.
  • "Vehicle" — refers to any motor vehicle (passenger car, SUV, truck, or commercial vehicle) sourced and imported by Al Sabah Motors on behalf of the Client.
  • "Order" — refers to the Client's confirmed request for the Company to source, purchase, and import a specific vehicle.
  • "Deposit" — the advance payment made by the Client upon confirmation of an Order.
  • "Delivery" — the physical handover of the imported vehicle to the Client in the State of Kuwait.
  • "Kuwait Customs" — the General Administration of Customs of the State of Kuwait.

2. Acceptance of Terms

By submitting a vehicle request, placing an Order, making a payment, or engaging with Al Sabah Motors in any commercial capacity, the Client confirms that they have read, understood, and agreed to be bound by these Terms and Conditions in their entirety.

These Terms and Conditions, together with any written Order confirmation or contract signed between the parties, constitute the complete and binding agreement between Al Sabah Motors and the Client.

If you do not agree with any part of these Terms and Conditions, you must not proceed with any transaction or engagement with Al Sabah Motors.

Commercial Activity: Import and Trading of Motor Vehicles

4. Services Provided

Al Sabah Motors provides the following services on behalf of Clients:

  • Sourcing and purchasing of new and pre-owned vehicles from international markets (USA, Germany, Japan, United Kingdom, and others)
  • Vehicle inspection and condition assessment coordination prior to purchase
  • International shipping and freight forwarding to Kuwait
  • Full customs clearance at Kuwait ports in compliance with Kuwait Customs Authority regulations
  • Assistance with vehicle registration documentation for the General Directorate of Traffic (Ministry of Interior)
  • Final delivery of the vehicle to the Client within Kuwait
  • Fleet procurement services for corporate and government clients

All services are subject to the specific scope agreed upon in the Order confirmation and any ancillary written agreement.

5. Order Placement and Contract Formation

5.1 Quotation

All quotations provided by Al Sabah Motors are estimates and are subject to market availability, exchange rates at the time of purchase, and prevailing import costs. A quotation does not constitute a binding offer.

5.2 Order Confirmation

A binding Order is formed only when: (a) the Client has confirmed in writing (including via WhatsApp, email, or signed agreement) their acceptance of the final price and terms; and (b) the required Deposit has been received and cleared by Al Sabah Motors.

5.3 Vehicle Availability

Al Sabah Motors sources vehicles through international auction platforms and dealers. The Company does not guarantee the availability of any specific make, model, trim, or color. In the event that a requested vehicle cannot be sourced within a reasonable timeframe, the Client will be notified and offered alternatives or a full refund of the Deposit.

6. Pricing and Payment

6.1 Total Cost Components

The total price quoted to the Client typically includes:

6.2 Payment Schedule

  • Deposit: A non-refundable deposit (amount specified in Order confirmation) is required upon Order placement to initiate sourcing
  • Balance Payment: The remaining balance is due prior to the vehicle being shipped from the origin country, or as otherwise specified in the Order confirmation
  • Additional Charges: Any unforeseen costs (storage fees, re-inspection costs, exchange rate fluctuations above 3%) will be communicated to the Client promptly and are payable before Delivery

6.3 Currency

All transactions are denominated in Kuwaiti Dinar (KWD) unless otherwise explicitly agreed in writing. Exchange rate fluctuations between the KWD and the currency of the origin country (USD, EUR, GBP, JPY) may affect the final price and will be disclosed transparently.

6.4 Late Payment

Failure to remit required payments within the specified timeframes may result in the Order being cancelled, storage fees being applied, and forfeiture of any Deposit paid. Al Sabah Motors reserves the right to sell any uncollected or unpaid vehicle after providing 30 days written notice to the Client.

7. Import Duties and Taxes

The import of motor vehicles into the State of Kuwait is subject to customs duties levied by the Kuwait General Administration of Customs. The applicable duty rate is generally 5% of the Cost, Insurance, and Freight (CIF) value of the vehicle, in accordance with GCC Unified Customs Law.

The Client acknowledges that:

  • Customs duty rates are set by Kuwaiti authorities and may change without prior notice
  • Al Sabah Motors acts as the customs agent on behalf of the Client and is not liable for duties levied by government authorities
  • Any customs assessment, re-examination fee, or additional government levy is the sole responsibility of the Client
  • All customs declarations made by the Company on the Client's behalf will be accurate and compliant with Kuwaiti customs regulations

8. Shipping and Delivery

8.1 Estimated Timelines

Shipping timelines are estimates and are subject to conditions outside Al Sabah Motors' control, including port congestion, vessel schedules, weather conditions, and customs processing times. Typical estimated timelines from date of purchase are:

  • United States (East Coast): 4–6 weeks
  • United States (West Coast): 5–7 weeks
  • Germany / Europe: 3–5 weeks
  • Japan: 4–6 weeks
  • United Kingdom: 4–5 weeks

8.2 Risk of Loss

The vehicle is covered by marine cargo insurance from the date of loading in the origin country until arrival at Kuwait port. Upon release from Kuwait Customs, risk of loss or damage transfers to the Client. The Client is advised to arrange comprehensive insurance immediately upon vehicle registration.

8.3 Delivery Location

Standard delivery is to the Client's specified address within Kuwait. Delivery outside Kuwait City governorate may incur additional logistics costs, which will be disclosed in advance.

9. Vehicle Condition and Inspection

9.1 Condition Reports

Al Sabah Motors will provide the Client with the available condition report and auction inspection data for any pre-owned vehicle prior to purchase confirmation. The Client acknowledges that condition reports from international auction platforms are provided by third parties and may not capture every defect.

9.2 Pre-Purchase Inspection

Upon Client request, Al Sabah Motors can arrange a pre-purchase physical inspection by an independent third-party inspector at the origin country. This service may incur additional costs and timelines.

9.3 "As-Is" Purchases

Pre-owned vehicles sourced from international auctions are sold on an "as-is" basis unless a specific written warranty or condition guarantee has been agreed upon in the Order confirmation. Al Sabah Motors does not manufacture vehicles and is therefore not liable for pre-existing mechanical, electrical, or cosmetic defects in pre-owned vehicles.

9.4 New Vehicles

New vehicles sourced from authorized international dealers are delivered with their original manufacturer warranty documentation, subject to the terms of that warranty in the relevant territory.

10. Cancellation and Refund Policy

10.1 Client Cancellation

The Client may request cancellation of an Order subject to the following conditions:

  • Before vehicle purchase in origin country: The Client may cancel with written notice. The Deposit minus any incurred sourcing and administrative costs will be refunded within 14 business days.
  • After vehicle purchase but before shipping: Cancellation is subject to recovery of the vehicle purchase price through re-sale. Refunds, if any, will be processed after deducting auction/dealer fees, transport to port, and Al Sabah Motors' service fee.
  • After vehicle has been shipped: No refund is possible. The Client remains liable for all shipping, insurance, customs, and delivery costs.

10.2 Company-Initiated Cancellation

Al Sabah Motors reserves the right to cancel an Order and return the Deposit in full if: (a) the requested vehicle cannot be sourced within 60 days; (b) sourcing conditions materially change making the transaction unviable; or (c) the Client fails to make required payments within specified deadlines after written notice.

Refund Processing: All approved refunds will be processed within 14 business days via the same payment method originally used by the Client, in accordance with Kuwaiti commercial practice.

11. Warranties and Limitation of Liability

11.1 Service Warranty

Al Sabah Motors warrants that it will perform its services with reasonable skill, care, and diligence in accordance with industry standards and applicable Kuwaiti law.

11.2 Exclusions

Al Sabah Motors is not liable for:

  • Delays caused by third-party carriers, port authorities, or customs clearance processes
  • Exchange rate fluctuations and their effect on total pricing
  • Vehicle defects, recalls, or issues not disclosed by or unknown to the origin seller
  • Actions or decisions of government authorities in Kuwait or origin countries
  • Loss of business, loss of profits, or consequential damages of any nature
  • Force majeure events including natural disasters, war, strikes, or pandemics

11.3 Maximum Liability

In no event shall Al Sabah Motors' total liability to the Client exceed the amount of the service fee paid by the Client for the specific transaction giving rise to the claim, as governed by the applicable provisions of Kuwaiti civil law.

12. Client Obligations

The Client agrees to:

  • Provide accurate and complete personal information, including valid civil ID or passport details, as required for customs and registration purposes
  • Ensure they hold legal capacity to enter into commercial agreements under Kuwaiti law (minimum age: 21 years, or as applicable)
  • Make all payments on time as specified in the Order confirmation
  • Collect or accept delivery of the vehicle within 7 days of being notified of its availability, failing which storage charges may apply
  • Not engage in any fraudulent, illegal, or misleading conduct in connection with any Order
  • Comply with all applicable Kuwaiti laws relating to vehicle ownership, registration, and operation

13. Intellectual Property

All content on the Al Sabah Motors website and marketing materials — including but not limited to text, images, logos, and design — is the exclusive property of Al Sabah Motors or its licensors. Reproduction, distribution, or commercial use of any content without prior written permission is strictly prohibited under Kuwaiti intellectual property law and international copyright conventions to which Kuwait is a signatory.

14. Governing Law

These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of the State of Kuwait, including:

  • The Kuwait Civil Code (Decree-Law No. 67 of 1980)
  • The Kuwait Commercial Law (Decree-Law No. 68 of 1980)
  • The Kuwait Consumer Protection Law
  • The Electronic Transactions Law No. 2 of 2001
  • GCC Unified Customs Law and its Kuwaiti implementing regulations

Nothing in these Terms shall be construed to conflict with any mandatory provision of Kuwaiti law. Where any provision is found to be inconsistent with Kuwaiti law, the applicable Kuwaiti legal provision shall prevail.

15. Dispute Resolution

15.1 Amicable Resolution

In the event of any dispute, claim, or controversy arising from or relating to these Terms and Conditions or any transaction with Al Sabah Motors, the parties agree to first attempt resolution through good-faith negotiation within 30 days of written notification of the dispute.

15.2 Mediation

If the dispute cannot be resolved through negotiation, the parties may refer the matter to the Kuwait Chamber of Commerce and Industry for mediation before commencing court proceedings.

15.3 Jurisdiction

The parties irrevocably submit to the exclusive jurisdiction of the Courts of the State of Kuwait for the resolution of any dispute that cannot be settled amicably. The competent court shall be determined in accordance with Kuwaiti procedural law.

16. Amendments to These Terms

Al Sabah Motors reserves the right to amend these Terms and Conditions at any time. Any amendments will take effect upon publication on this website, with the updated "Effective Date" noted at the top of the page. It is the Client's responsibility to review these Terms periodically. Continued engagement with Al Sabah Motors following any amendment constitutes acceptance of the revised Terms.
